The term Marina includes: Seawall, Docks, slips, dry-sail (designated areas on land where kayaks, SUP, … are stored). The marina is considered common elements with assigned slips reserved for the use of the renter. It is the responsibility of the Ocean Cay Board of Directors to set all the rules and pricing.
General Rules
All vessels assigned a slip must be in operable condition capable of going to sea under their own power. The determination of “operable condition” shall be the decision of the Board of Directors.
Kayaks, canoe, Stand-up boards can only be stored in designated dry-sail areas.
Only members, their guests and employees of the Ocean Cay Condo Associations are allowed in the slip area. Boat owners who permit guests to use their boat must be on the property at the time of departure and return.
All docks, seawall and walkway are common elements and are to remain furniture free except for occasional day use, after which furniture is to be returned to the owner's unit.
Fish cleaning on the docks is prohibited.
Open fires, including any type of cooking grill, are prohibited.
The pumping of bilges or holding tanks and the disposal of refuse are prohibited by law.
Ocean Cay Condo Association is not responsible for vessels while berthed at the facility. It is the responsibility of the boat owner to maintain adequate insurance to cover his/her vessel against loss by theft, fire, storm, damage, vandalism, deterioration, or any so-called Acts of God.
Every boat in the slip area must submit a copy of the up-to-date registration and insurance policy within 30 days of yearly renewal.
Slips are rented on a quarterly basis; no pro-rating or refunds are allowed for partial occupancy. A schedule of the slip fees will be calculated annually as part of the annual budget process.
Ocean Cay does not permit “living aboard”.
Length of boat for the purpose of calculating price is to be the Length-overall (LOA): from the bowsprit to furthest point on the stern (outboard engine in the docked position).
Maximum length of boats at the slips after October 2023 is not to exceed 28 feet (LOA)
Exception to the length rule is made for unit #11 existing Fountain Lighting at 35’. This exception does not survive the sale of said vessel.
No boat owner shall impede or occupy another owner's slip without written authorization.
Water levels in the channel leading into the boat slip area may decline significantly at certain times. Owners, their tenants, family members, guests and invitees assume all risks created by such fluctuations in water levels.

Slips are assigned at the discretion of the Board of Directors.
The Board reserves the right to suspend the assignment of boat slips for a period of time to effect repairs or other structural changes.

No member will be assigned more than one in-the-water boat space when there are other members on the waiting list. In the event a waiting list for dry-sail spaces is necessary, priority will be given to members without in-the-water assignments.
Slips and dry-sail spaces are assigned based on the best solution to demands on available space and to maximize revenue for the association.
Assignments will not be transferred with the sale or other transfer of a vessel between or among members.
Slip holders from the prior year shall have priority for suitable assignments in subsequent years. This does not apply to: Members who purchase boats of different lengths, beam and/or draft.
Changing Boats: A member occupying a slip who plans to change boats should immediately inform the board in writing of the length, beam, and draft of the new boat to determine if it can be accommodated in the marina. “Assignment Priorities” (see above) will apply.
A member may not charter, lease or otherwise “share” a boat with anyone outside the association or with another member for the purpose of transferring a slip assignment.
